I do believe that a program that actually depicts fireworks has legal precedence over a program that does not, at least to use the generic word Fireworks.

Um... I'm not sure what you mean. I don't claim to have writen the script but I found it on a site that lists free javascripts for free use- so Adobe should be after them not me. All I did was put it into widget form.
