Take a look in the Activity Monitor. Look for a process named like PTHVolume and quit it. You should then be able to empty the trash. Also check Startup Items in the Accounts system preference to make sure that PTHVolume isn't listed there. If it is, delete it. Next time you start up your computer it should be gone.
