DL2 extensively uses technologies in Leopard, and it's a paid update (the upgrade cost is $20). Shipley's been talking about that for a while now - it's why DL1 was featured as part of MacHeist. (No one took into account Apple's last-minute manoeuvers with 10.5's release, which led to the lengthy delay.)
