I would suggest that the developer should check out the legality of the usage of the name "Pathway"
"Pathway" is a copyright protected, and possibily Trade Marked software programme owned by the United States Trotting Association - the USTA - I would suggest the developer should
contact the USTA and get WRITTEN approval to use that name before some zealot decides to sue him!

I can legally call my new book store McDonalds, as they are not the same industry. You can call your software the same name as them, as long as it is completely dissimilar in function and no reasonable person would confuse the two.

It should be noted one can't "copyright" a name. One can registered a name as a "trademark". As also stated, many products, services, companies, etc. also share the same or similar names. As long as all parties involved make make it clear such products/services/companies/etc. are separate and non-infringing all is typically well.In case, VT is hardly the forum for trotting out such issues. If you have anything constructive to post about the application and it's functionality, please share it. VT isn't the place for scare tactics and lawsuits.
