Poisoned is open-source. It's irrelevant what "permissions" the author of XFactor has for using the Poiosened code as he is legally entitled to do so.

Poisoned is licenced under the GPL. The creator of Xfactor is NOT entitled to use it unless he makes the source code for his changes available.
